Privacy policy

This policy explains what we collect, why we collect it, how long we keep it and how to have it removed. It covers our website and the commission process, including the three dimensional captures we take.

Who we are

niko dov Studio is a Canadian studio producing commissioned sculpture. For questions about this policy, or to make any request described in it, write to [email protected]. We handle personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act, and with Quebec's Law 25 where it applies.

What we collect

When you join the private list

The registration form collects, as required fields, your name and email address, the milestone you are marking, and your preferred city. Optionally it collects your phone number, current week of pregnancy, due date, finish and plinth preferences, how you heard about us, and anything you write in the notes field.

We ask for your week of pregnancy and due date for one reason: to work out when a session would fall for you, and which city to open first. It is used for scheduling and nothing else.

When you commission a piece

If you go on to commission a sculpture we also collect the information needed to complete it: your shipping address, billing details and the record of your deposit and balance. Payments are handled by our payment processor. We do not store your full card number.

When you sit for a capture

A capture is a three dimensional record of the surface of your body. We treat it as the most sensitive information we hold, and the section below sets out exactly what happens to it.

When you visit this website

Our host records standard technical information such as your approximate region, browser type and the pages you viewed. We also use advertising tags from Meta and Pinterest, which are described under Analytics and advertising below.

Your capture

It is never shared. Your capture and any model derived from it are never sold, never licensed, never given to third parties for their own purposes, and never used in our marketing, portfolio or social media without your specific written permission. Consent to one use is not consent to any other, and you can withdraw it at any time.

It is stored anonymously. Your file is labelled with a unique reference number rather than your name. That reference is what travels through production, so the people who make and finish your sculpture work from a number and never see whose body it belongs to. Only the studio holds the link between the reference and you.

It is held for one year, then deleted. We keep your capture for twelve months after your session so that you can commission a second piece without sitting for another one. At the end of that period it is deleted.

You can have it deleted sooner. Email [email protected] at any time and we will delete your capture and confirm when it is done. If your sculpture is still in production we will tell you what this means for that piece before we act.

How we use your information

We do not sell your personal information. We do not rent, trade or otherwise disclose it for anyone else's marketing.

Who else touches it

We use a small number of service providers to run the studio. Each receives only what it needs to do its job, and none is permitted to use your information for its own purposes.

Some of these providers store information on servers outside Canada, including in the United States, where it may be subject to the laws of that country. We choose providers that commit to appropriate protection.

Analytics and advertising

This site uses two advertising tags. Both record that a visit took place, let us show advertising to people who have visited the site and to people who resemble them, and tell us how many registrations came from a given advertisement. Neither is given your name, email address or anything else you typed into the registration form.

Both providers are based in the United States and process this information there.

You can limit this in your Facebook, Instagram and Pinterest ad settings, and most browsers let you block tracking cookies outright. Blocking either tag does not affect your ability to use this site or to join the list.

If you have arrived here from a Pin, Pinterest may also record that click on its own side under its own privacy policy, which is not something we control.

How long we keep things

Your rights

You can ask us to show you what we hold about you, correct anything that is wrong, delete your capture, remove you from the private list, or withdraw a permission you previously gave. Write to [email protected] and we will respond within thirty days.

Every email we send includes a way to unsubscribe. Leaving the list does not affect a commission already in progress.

Security

Captures and personal information are held in access controlled storage. The reference numbering described above means that even inside the production chain your file is not connected to your identity. No system is perfect, and we do not claim otherwise, but if a breach ever affected your information we would tell you and the relevant authorities as the law requires.

Children

This site and our commissions are intended for adults. We do not knowingly collect information from anyone under the age of majority in their province.

Changes

If we change this policy we will update the date at the top of this page. If a change materially affects how we handle captures, we will email everyone on the private list rather than rely on you noticing.

Contact

Questions, requests and complaints all go to the same place: [email protected]. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada.
